PAMOJA AFRICA: TERMS AND CONDITIONS

1. Acceptance of Terms
By accessing the Pamoja Africa platform, you agree to be bound by these Terms and Conditions. Pamoja Africa is a financial and data intermediary and does not provide medical advice or services.
2. Medical Archive & Acceptable Use
The Medical Docs feature is for the sole purpose of storing relevant health records for emergency or clinical reference.
- Prohibited Content: You may not upload non-medical files, illegal content, or information that infringes on third-party intellectual property.
- Accuracy: You are responsible for the accuracy of the records you upload. Pamoja Africa is not liable for clinical errors resulting from outdated or false documents provided by the user.
3. Health Voucher System
- Redemption: Vouchers are redeemable only at certified Pamoja Healthcare Partners.
- Non-Refundability: Prepayment for vouchers is non-refundable for cash but remains valid as credit within the Pamoja network.
- Transferability: You may transfer vouchers to other Pamoja members.
4. Crowdfunding & Unclaimed Funds
- Direct Disbursement: All funds raised via community crowdfunding are paid directly to the designated Healthcare Partner. No cash is disbursed to individual users.
- Excess Funds: If the funds raised exceed the specific medical invoice, the excess amount will remain in your Pamoja Wallet as a general healthcare voucher.
- Unclaimed Funds: If a campaign becomes inactive or the partner relationship is terminated, unclaimed funds will be held in escrow as digital credits for the beneficiary for 12 months, after which they may be allocated to the Pamoja General Hardship Fund [TO BE COMPLETED BY LEGAL COUNSEL].
5. Agent Referral Program
- Status: Agents are independent contractors. Commission structures (e.g., R25 per NFC card) are performance-based and subject to change with 30 days' notice.
- Payouts: Minimum payout thresholds apply (typically R100).
6. Limitation of Liability
Pamoja Africa shall not be liable for the failure of a healthcare provider to render services or for any medical malpractice occurring at a partner facility.
7. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Johannesburg.
